RussianMatch.ru offers an access to fee-paying services of web site http://russianmatch.ru to any individual. According to article 438 of Russian Federation Civil Code, the acceptance of present offer conditions is making the payment for the service and receiving appropriate documents confirming the fact of the payment.
1. General Conditions
1.1. The services offered imply fee-paying access to data resources and services of the web-site http://russianmatch.ru
2. Rights and obligations of the parties
2.1. Obligations of RussianMatch.ru:
2.1.1. to provide the services to the user by means of his registration and activation of the access to the fee-paying services of the web-site http://russianmatch.ru after receiving the payment on the account of RussianMatch.ru. The fact of providing the service is considered as confirmed from the moment the user makes the payment and the payment is received on the account of RussianMatch.ru.
2.1.2. to register the user by giving him an account name (login) and password.
2.1.3. to provide the services according to the amount of the payment made.
2.1.4. to ensure of privacy of all information provided by the user at the registration and the privacy of the content of private e-mail messages except for the cases mentioned by current legislation of Russian Federation.
2.1.5. to publish the official announcements with regard to providing the User with services and changes of the rates of payments on the web-site http://russianmatch.ru.
2.1.6. to provide the user with access to his account at the site http://russianmatch.ru
2.1.7. to provide with access to fee-paying services 24 hours a day during the weekdays, weekends and official holidays except for the cases mentioned in clause 4.8 of the present offer.
2.2. Obligations of the User
2.2.1. to pay for the services according to the rates of RussianMatch.ru. The User is obliged to read himself the information concerning the conditions of providing services and rates at the site http://russianmatch.ru
2.2.2. to keep the appropriate financial documents confirming his payment for the services.
2.2.3. to read the official information concerning providing services to the User including the rate changes, at least once a week;
2.2.4. the User is obliged not to give or sell to the third parties without written permission of RussianMatch.ru his personal network data (login and password) necessary for getting the service.
2.3. Rights of RussianMatch.ru
2.3.1. to suspend providing the services to the User until RussianMatch.ru gets written explanation from the User in the following cases:
a) the payment for the services isn't received on the account of RussianMatch.ru in the terms set by the tariff rate of RussianMatch.ru
b) actions aimed at limiting and blocking the access of other users to the web-site RussianMatch.ru
c) sending messages with the information distribution of which is prohibited by the Russian Federation legislation and by the rules of the web-site RussianMatch.ru through the web-site http://russianmatch.ru
d) mass mailing of commercial or other e-mail messages. Mass mailing is understood as mailing of many messages to multiple users as well as sending multiple messages to one user.
e) breaching Members Terms and Conditions Agreement (http://russianmatch.ru/terms_conditions.html)
2.3.2. if the User violates the terms of the present offer RussianMatch.ru is entitled
to cancel the agreement unilaterally sending him a written notification via e-mail. The date of sending this notification to the User is considered to be the moment of violating the agreement.
2.3.3. RussianMatch.ru has the right to control the information going through its services and expose it if it's necessary according to the Russian Federation Legislation, demands of Authorized State Institutions or for normal functioning of the services and for protection of the site RussianMatch.ru and its users if it doesn't contradict applicable rights of individuals.
2.3.4. RussianMatch.ru has the right to change the conditions of the present offer unilaterally. The present offer comes into force on the date of its placing at the site http://russianmatch.ru.
2.4. Rights of the User
2.4.1. to demand providing the services in accordance to the terms and conditions of the present offer from RussianMatch.ru
2.4.2. to cancel the present agreement unilaterally if the User doesn't agree with any rate changes or if RussianMatch.ru breaches the conditions of the present offer. In the case of breaching the agreement without reasonable excuses the money from the User's account is not refunded.
3. Service Prices and Terms of Payment
3.1 The price of the services is defined according to the tariffs published on the page http://russianmatch.ru/members/.
3.2 RussianMatch.ru has the right to reconsider the prices on the services unilaterally and to extend the amount of services. RussianMatch.ru informs the User about the changes of the prices in advance, having published the message about it at the site of RussianMatch.ru not later then 7 (seven) calender days before entering new prices into force.
3.3 The payment for the services is made by wire transfers.
3.4 The User is responsible for the correct order and amount of his payments. In the case of the changes of banking requisites of RussianMatch.ru, the User is responsible for the payments made by old banking requisites starting from the moment of publishing new requisites at the site RussianMatch.ru.
3.5 The fact of the payment is considered to be confirmed and the access to the fee-paying services of the site RussianMatch.ru is considered to be opened after getting the confirmation from the bank about the arrival of the payment to the account of RussianMatch.ru.
3.6. The User's login and the contents of his mail-box at the site http://russianmatch.ru are available for the user during 90 days from the date of the ending of the paid period of using the fee-paying services at the web-site http://russianmatch.ru. Upon the expiry of this period the content of the mail-box of the User will be automatically deleted.
3.7. The User is aware of and agrees with the fact that the RussianMatch.ru controls the User's payments. The access to the RussianMatch.ru services is automatically denied from the date of the ending of the paid period and can be renewed only after the payment according to the terms of the present offer.
4. Special conditions and responsibilities of the parties.
4.1. RussianMatch.ru doesn't guarantee absolute uninterrupted operation and impreccability of the services. RussianMatch.ru takes all possible measures and efforts to avoid it.
4.2. RussianMatch.ru is not responsible for direct or indirect losses borne by the User because of the using or impossibility of using the services or because of mistakes, interruptions, deletion of the files, defects, delays of work or sending the data or changes of functions for other reasons.
4.3. RussianMatch.ru is not responsible for the network channels by means of which the User receives the access to the services.
4.4. The User takes the full responsibility and risks connected with the usage of the fee-paying RussianMatch.ru services.
4.5. The User is fully responsible for his password and for the losses he may take because of unsanctioned using of the password.
4.6 RussianMatch.ru is not responsible for informing any third parties about depriving the access of the User and for any possible circumstances, arising as a result of the absence of such warning.
4.7 RussianMatch.ru is not a bearer of responsibility or a co-respondent on any obligations and expenses if the User or some other people who use the login and a password of the User breach the above mentioned conditions. Or if the User or any other people who use his login and his password use the site RussianMatch.ru via the service and send any messages.
4.8 RussianMatch.ru has the right to suspend providing the service for no longer then 24 hours per month for scheduled maintenance.
4.9 The parties bear the responsibility according to the current legislation and present agreement if the obligations of this agreement are not fulfilled or fulfilled in a wrong way.
4.10 The Member agrees with the condition that after the payment for the membership has been received to the account of the Agency and after signing the present agreement, the Member has no right to demand the return of the payment and the Agency is entitled not to refund the payment to the Member for any reasons.
4.11 The Member is aware and agrees with the condition that from the moment of confirmation of the payment for any service of the RussianMatch.ru received to the account of the Agency, the Agency is entitled not to refund the payment to the Member for any possible reasons.
4.12 By the fact of making the payment for the service of RussianMatch.ru the User confirms that he agrees with the Terms and Conditions of this public offer and with Members’ Terms and Conditions Agreement.
5. THE ORDER OF CLAIMS' AND CONTROVERSIES’ INVESTIGATION
5.1 The claims of the User on the provided services are accepted by RussianMatch.ru for investigation only in the written form no later then 3 calendar days from the date of the controversial situation. The terms of the investigation of the User's claim are no longer then 14 (fourteen) working days.
5.2 The investigation of claims to RussianMatch.ru connected with the providing with the services is executed only when the User provides the relevant financial documents which confirm the payment made for the services.
5.3 RussianMatch.ru has the right to invite qualified organizations as experts for solving technical issues in defining the guilt of the User as the result of his illegal actions while using the site RussianMatch.ru.
6. THE MOMENT OF SIGNING THE AGREEMENT. THE VALIDITY PERIOD. THE ORDER OF INSERTING CHANGES AND OF CANCELLATION.
6.1 Present agreement comes into force starting from the moment of making the payment for the services in the order determined by this agreement and is considered to be extended after the next following payments are made, according to the active tariffs for the date of payment.
6.2 The agreement can be cancelled ahead of schedule:
(a) on the agreement of the Parties;
(b) unilaterally because of other reasons, set by this agreement or mentioned in the active legislation of Russian Federation.
6.3 The Parties act according to the active legislation of Russian Federation on all the issues not mentioned in the written above offer.
